Privacy Notice

Last updated 10 October 2026

This notice explains what personal data Pwani Estates collects through this website, why we collect it, who we share it with and how long we keep it. It is written to meet the Kenya Data Protection Act, 2019.

  1. 1.Who we are

    Pwani Estates is the data controller for personal data collected on this site. You can reach us at info@pwaniestates.co.ke, on +254 735 900 555, or at Lamu Road, Malindi, Kilifi County, Kenya.

  2. 2.What we collect

    Only what you give us, through the forms on this site:

    • Enquiries and viewing requests: your name, email address, phone number, the property or kind of property you are interested in, preferred dates, and anything you write in the message.
    • Newsletter: your email address.
    • Owner and advisor portals: your account details, the property details you submit, and any documents you upload, such as a title deed or identification. Documents are held in private storage that is not publicly reachable.

    This site does not use advertising or analytics trackers of its own. If you sign in to a portal, a cookie keeps you signed in; it is not used for anything else.

    Listing and contact pages show an embedded Google Map. When it loads, Google may set its own cookies and receives your IP address and browser details, under Google's privacy policy. The listing pages also link to WhatsApp, which applies its own terms if you use it.

  3. 3.Why we use it

    • To answer your enquiry and arrange viewings you ask for.
    • To list, market and manage a property you instruct us on.
    • To send the newsletter you subscribed to. Ask us to stop at any time and we will.
    • To meet legal obligations, including record-keeping on property transactions.
  4. 4.Who we share it with

    We do not sell personal data. We share it only where needed to do what you asked:

    • Our advisors, who handle your enquiry.
    • Where you proceed with a transaction, the advocates, surveyors and registries involved in it.
    • Google, through the maps embedded on listing and contact pages, as described in 2.
    • The providers that host this site and its database, under terms that let them process the data only on our instructions. Some of this hosting is outside Kenya; where it is, we rely on the safeguards the Act requires for such transfers.
  5. 5.How long we keep it

    Enquiries that do not lead to a transaction are kept for up to two years, then deleted. Records connected to a property transaction are kept for as long as the law requires. Newsletter addresses are kept until you unsubscribe.

  6. 6.Your rights

    Under the Act you may:

    • be told whether we hold data about you, and get a copy of it;
    • have inaccurate data corrected;
    • have data deleted where we no longer have a reason to keep it;
    • object to its use for marketing at any time.

    Write to info@pwaniestates.co.ke and we will respond within the time the law sets. If you are unhappy with our answer you may complain to the Office of the Data Protection Commissioner (ODPC).

  7. 7.Changes to this notice

    If this notice changes, the date at the top changes with it. See also our terms of use.
